Cryptex Finance has updated its filing for a proposed Digital Market Cap ETF, with XRP making up 4.88% of the fund’s weighting.
The filing has attracted attention because it includes a statement suggesting that Ripple could release more XRP from escrow if the United States achieves greater regulatory clarity through legislation such as the CLARITY Act.
However, the statement comes from Cryptex’s filing and is not an announcement from Ripple or a finding by the U.S. Securities and Exchange Commission. Ripple has not publicly confirmed any plans to release additional XRP.
The proposed ETF, which would trade under the ticker BAGZ, is designed to track a diversified basket of digital assets. XRP accounts for a notable portion of the fund based on the latest allocation.
Some industry observers have questioned the source of Cryptex’s claim. Legal experts pointed out that the filing does not identify where the information came from or provide any direct comments from Ripple representatives.
It is also important to note that Ripple cannot simply unlock XRP held in existing escrow accounts before their scheduled release dates. The XRP Ledger’s built-in rules prevent escrowed tokens from being accessed early. Each escrow contract follows a set timeline that cannot be bypassed.
Ripple currently releases a scheduled amount of XRP each month and often places a large portion of the unused tokens back into new escrow contracts. Some analysts believe Cryptex may be referring to the possibility that Ripple could keep more of those monthly releases in circulation rather than returning them to escrow. Still, that remains speculation and has not been confirmed by the company.
The filing also connects the possibility of increased XRP distribution to the proposed CLARITY Act, a U.S. bill that aims to provide clearer rules for the digital asset industry. However, the legislation has not yet become law, and its future remains uncertain.
For now, investors are watching for any official comments from Ripple or future updates to the ETF filing. Until then, the statement should be viewed as a claim made in Cryptex’s registration document rather than confirmed evidence of a change in Ripple’s XRP strategy.
